Customs Compliance Manager Organizational Structure Location
Ensure that all the company’s foreign trade operations (import, export, programs related to IMMEX, qualification of origin of finished products, and payment of Duties in Mexico and the USA) are carried out in compliance with customs, tax, and foreign trade regulations applicable in Mexico and the USA, minimizing legal, fiscal, and administrative risks.
Guarantee that the company is in Compliance with the requirements and obligations of the IVA-IEPS, Authorized Economic Operator (OEA), and C-TPAT (Customs-Trade Partnership Against Terrorism) certifications.
Determine the correct tariff classification of import and export products based on applicable legal provisions.
Fiscal and Customs Certifications
# Lead the IVA-IEPS Certification process applicable to imports, ensuring that the company meets legal requirements, maintains adequate documentation, manages audits, and submits required reports to the authority.
# Manage and maintain the Authorized Economic Operator (OEA) Certification, coordinate audits, improvement plans, internal controls, document maintenance, personnel training, and periodic process review.
# Certification : coordinate supply chain security actions, internal and external audits, risk mitigation, and compliance with program standards.
Design and execute the origin analysis program for finished products, applying the Rules of Origin of the Free Trade Agreement with the USA and Canada (T-MEC / USMCA).
# Perform origin compliance evaluations, calculation of regional / non-regional value content, analysis of critical inputs, calculation methodology, De Minimis, and origin audits.
# Customs / Fiscal / Commercial Regulatory Compliance
# Interpret and keep updated Compliance with Mexican regulations : Customs Law and its Regulations, Foreign Trade Law and its Regulations, VAT Law, General Import and Export Tax Law, General Rules of Foreign Trade, IMMEX and Prosec Decrees, etc.
# Develop compliance indicators (KPI), risk reports, compliance monitoring, and early alerts.
# Propose, design, and implement internal controls, policies, procedures, and best practices of Customs Compliance.
# Train and disseminate among personnel of Foreign Trade, Logistics, and related departments (purchasing, quality, production) the regulations, risks, and Responsibilities.
# Coordinate with Legal / Fiscal / Internal Audit areas to evaluate implications of sanctions, contingencies, fines, and review notices.
